SPRING TRAINING RAFFLE"
OFFICIAL TERMS AND CONDITIONS
- By participating, entrants agree to be bound by these
OFFICIAL TERMS AND CONDITIONS and by the decisions of the Board of
Directors of Socks For Siberia, Inc., which shall be binding and final as to
all matters related to the Raffle. The Raffle is subject to all applicable
federal, state and local laws.
- SPONSOR: Socks For Siberia, Inc., 122 Long Hill Road,
Brookfield, MA 01506, a 501(c)(3) Non Profit Charitable Organization,
Federal ID#20-8568746; sanctioned to Solicit in the state of Massachusetts,
Attorney General's Account # 048196
- NET PROCEEDS: All net proceeds of the Raffle will benefit
Socks For Siberia, Inc., a 501(c)3 public charity (hereafter known as
"Sponsor") and the programs and charitable donations that Sponsor supports.
- GRAND PRIZE: One winner will win the following Grand
Prize to be drawn at 3:00pm EST at Sacred Heart Church, 10 Milk Street, West
Brookfield, Massachusetts 01585: Grand Prize will consist of the
following: Round Trip coach air travel for two persons from Boston Logan
Airport, Boston, Massachusetts provided by Jet Blue Airlines (dates of air
travel is subject to availability); 5 night deluxe
accommodations for two people (consisting of one room with one king double bed or
one room with two queen size beds); two tickets to two Red Sox Spring
Training games at JetBlue Park, Fort Myers, Florida; a tour of JetBlue Park
provided by the Boston Red Sox; two tickets to a Minnesota Twins Spring
Training game at Hammond Field, Fort Myers; rental car or airport hotel
transfers with taxi service to the ball parks; complimentary breakfast and
dinner each day (five dinners and five breakfasts). Complimentary dinners
and breakfasts will be provided in the form of Gift Cards or Gift
Certificates provided by our sponsors, with a $25.00 maximum responsibility
by the Sponsor for each breakfast for two persons, and a $50.00 maximum
responsibility by the Sponsor for each dinner for two persons. There is a
$200.00 maximum responsibility by the Sponsor for providing rental car or
ground transportation. Excess costs for any amount over the maximum amount
allotted by the Sponsor is the responsibility of the Official Winner. Rental
Car reservations and purchase will be the responsibility of the Official
Winner of the Raffle, subject to the terms and conditions of the rental car
agency or ground transportation agency selected by the Sponsor, requiring a
major credit card from the Official Winner's Grand Prize recipients to secure the rental car provided
as part of the Grand Prize.
The Official Winner of the Raffle is not obligated to use the breakfast,
dinner, rental car, ground transportation, or accommodations
agencies selected by the Sponsor but hereby agrees to be responsible for the
costs associated with selecting a different agency for these services during
the time frame selected for the Grand Prize. Dates of travel, Spring
Training Game dates, accommodation dates, and all other dates and times
associated with the Grand Prize are negotiable during the month of March
2012. The Resident Agent of the Sponsor will conduct all negotiations with
the Official Winner to complete all arrangements for the dates and times of
the Grand Prize. Tickets awarded to the Official Winner for the three Spring
Training Games cannot be resold. In the event any of the three Spring
Training Games are postponed or rescheduled for any reason, the Sponsor is
not liable to extend the dates of the Grand Prize to accommodate the
rescheduled game outside of the final dates of travel selected by the
Official Winner. The Sponsor will make every effort to assist the Official
Winner with any necessary rescheduling of events during the final dates and
times selected by the Official Winner. Every reasonable effort will be made
by the Sponsor to cater to the scheduling requests of the Official Winner
for dates and times of the Grand Prize. However, the Sponsor reserves the
right to determine final dates and times of the Grand Prize. The Grand Prize
can be transferred to a Potentially Eligible person by the Official Winner,
upon approval of the Board of Director's of the Sponsor, however, the Grand
Prize cannot be sold in any manner by any Eligible Recipient at any time.
- Raffle tickets MAY BE PURCHASED ONLY BY PERSONS 18
YEARS OR OLDER in accordance with these Official Rules. Raffle tickets
may NOT be purchased by anyone under the age of 18, regardless of location
or method of purchase. Tickets are available for purchase IN PERSON by
anyone 18 years and older, REGARDLESS OF THEIR STATE OF RESIDENCE. The
Raffle ticket sales locations include 122 Long Hill Road, Brookfield, MA,
01506, other Massachusetts locations, the Sponsor's website, and by phoning
the Sponsor's primary place of business. This Raffle is void wherever
prohibited by law.
- The following persons are NOT ELIGIBLE to participate in
the Raffle or to win the GRAND PRIZE: Officers, Directors, and agents of
Socks For Siberia (Sponsor) and immediate family members of any Ineligible
Party. "Immediate family members" means spouses, parents, grandparents,
children, grandchildren, and siblings (and any of their respective spouses)
of an Ineligible Party.
- PURCHASING RAFFLE ENTRIES: The price of each
raffle ticket is $10.00. Each $10 ticket will have 4 numbers on it. Tickets
may be purchased in multiples of $10. No discounts or complementary tickets
will be given. Raffle tickets will be available for purchase in person by
eligible persons (see "ELIGIBILITY TO ENTER" above). Official Rules are
available from volunteers of Socks For Siberia, Inc. for review and will be
posted on Sponsor's website:

- RAFFLE TICKETS ARE NONDEDUCTIBLE: No portion of
the Raffle ticket price may be deducted as a charitable contribution for
federal income tax purposes.
- NUMBER OF RAFFLE TICKETS: There is no minimum
number of $10 tickets that must be sold. The number of $10 tickets sold
will be capped at a maximum of 2012.
- ODDS: The odds of winning the Grand Prize depends
on the number of valid tickets sold. A maximum of one prize will be awarded.
If the maximum number of tickets are sold, your chances of winning are 1 in
2012 as there are 4 numbers per $10 ticket. If fewer tickets are sold, your
odds are greater.
- TRANSFER OF RAFFLE ENTRIES: Persons who purchase
Raffle tickets may opt to give away their raffle tickets to others, but in
doing so they give up any claim they might otherwise have to the Prize if
they surrender a winning Raffle ticket. Raffle tickets purchased in person
may be given away to persons who are under 18 years of age, but only
individuals who are 18 years of age or older may claim or win a Prize. The
Raffle is being conducted pursuant to a raffle permit issued to Sponsor by
the Town of Brookfield, MA. Purchasers of Raffle tickets may not re-sell
their Raffle tickets to other parties, and may not knowingly give such
Raffle tickets away to others for the purpose of allowing those other
parties to re-sell such Raffle tickets. All Raffle tickets which have been
resold in violation of these Official Rules shall be void. All individuals
who re-sell Raffle tickets in violation of these Official Rules shall be
ineligible to participate in the Raffle or to win the Prize.
- DRAWING: Potential winner will be selected at the
place and time posted above by a drawing of the eligible raffle ticket stubs
collected by the Sponsor by a random individual present at the time of the
drawing, in the presence of at least five witnesses, who is in no way
connected to the running of the Raffle by the Sponsor. The Sponsor will
attempt to contact the winner by telephone immediately following the
drawing, in the presence of witnesses. In the event the Sponsor is unable to
contact the winner listed on the drawn ticket, the winning ticket number will also
be posted on www.socksforsiberia.org within 24 hours of the drawing and will
remain posted on the website for 30 calendar days. As provided below under
"NOTIFICATION OF POTENTIAL WINNER," the owner of the winning Raffle ticket
number has 30 calendar days from the date of the drawing to claim their
Prize. Winner need not be present to win. A forfeited prize will be retained
by the Sponsor and will be redrawn at a time and place to be posted on
www.socksforsiberia.org 31 days
after the original drawing date.
- POTENTIAL WINNER MUST CONTACT SPONSOR: POTENTIAL
WINNER MUST CONTACT SPONSOR DIRECTLY TO BEGIN THE PROCESS REQUIRED TO CLAIM
HIS/HER PRIZE NO LATER THAN THIRTY CALENDAR DAYS AFTER THE WINNING NUMBER
WAS SELECTED. CONTACT CAN BE MADE BY TELEPHONE, EMAIL, OR IN PERSON TO BEGIN
THE AWARD PROCESS
- DETERMINATION OF OFFICIAL WINNER: Sponsor shall
have the sole discretion to determine whether the Potential Winner is an
official winner of the Grand Prize, (an "Official Winner"). Sponsor’s
decision concerning the identity of all Official Winners shall be final and
binding. To become an Official Winner: (1) a Potential Winner must be
eligible to participate in the Raffle under these Official Rules and must
not be in violation of these Official Rules as determined in Sponsor’s sole
judgment; (2) that Potential Winner must contact Sponsor by the deadline
specified above under "NOTIFICATION OF POTENTIAL WINNER"; If for any
reason whatsoever all of the foregoing requirements are not satisfied with
respect to a particular Potential Winner, or if Sponsor is unable for any
reason to identify the holder of a winning Raffle Ticket or to contact a
Potential Winner, then that Potential Winner’s Prize will be deemed
forfeited and, the Prize will be retained by the Sponsor for charitable use.
- TAXES: All federal, state and local income taxes
are the sole responsibility of the Raffle Official Winner.
- GENERAL CONDITIONS: The Released Parties (defined
below under "RELEASE OF LIABILITY") are not responsible for: (1) Chances
which are stolen, lost, damaged, or illegible (2) Chances that have been or
may have been tampered with or re-sold in violation of these Official Rules;
(3) Chances or payments that are delayed, misdirected, undelivered, not
fully captured, or garbled as a result of any failure or problem whatsoever
with the availability, functionality, operability or use of any network,
server, ISP, website, computer, telephone, cable or satellite modem or
connection, hand held mobile device or any other computer equipment or
connection, whether or not caused by site users, tampering, hacking, or by
viruses, worms, or malfunctions affecting a network, server ISP or any
equipment or programming used in or associated with the Raffle; (4) any
other errors of any kind, whether human, typographical, printing,
mechanical, or electronic in nature, which relate to or are connected with
the Raffle (collectively, as described in clauses (1) through (4),
"Errors"), including without limitation Errors in Raffle-related materials
or in the administration of the Raffle, such as Errors in processing
Chances, identifying Potential Winners, determining Official Winners, or
announcing or delivering Prizes; or If any portion of the Raffle is
compromised, in Sponsor’s sole judgment, by a virus, worm, bug,
non-authorized human intervention or other causes which, in Sponsor’s sole
judgment, corrupt or impair the administration, security, fairness or proper
play of the Raffle, or the proper submission or capture of Chances
(collectively, a "Compromising Event"), then Sponsor reserves the right, in
its sole discretion, to suspend, modify or terminate the Raffle, and to
select winners from all eligible, non-suspect Entries received before the
known occurrence or discovery of such Comprising Event. All Chance purchases
shall be final, and no refunds or replacements will be issued by Sponsor.
Sponsor has sole and final decision on admissibility of entries and the
determination of prize winner.
